Terms and Conditions

These terms are the agreement between you and 28 bit S.R.L. (Single Member Company), C.O.E. SM31527, Strada di Paderna 2, 47895 Domagnano (RSM), Republic of San Marino, for the use of the Ghost Editor app. By using the app you accept them. How we handle your data is described in our Privacy Policy.

What the app does

Ghost Editor transcribes what you recorded and removes filler words and silences from it. Transcription is automatic and imperfect: it will sometimes cut a word you wanted or keep one you did not. Every cut can be reviewed and undone in the app before you export, and doing that review is your responsibility, not ours.

Who can use it

You must be at least 13 years old to use Ghost Editor. If you are under the age of majority where you live, you need the permission of a parent or guardian, including for any purchase.

Your account

You need an account to use the parts of the app that rely on our servers. Give accurate details when you create it, keep your sign-in details to yourself, and tell us at hello@ghosteditorapp.com if you think someone else is using your account. You are responsible for what happens under your account.

You may delete your account at any time from inside the app. Deleting your account does not cancel your subscription: cancel it in your Apple Account settings, or Apple will keep renewing it.

Your content is yours

Everything you record and everything you export stays yours, and you may use it for any purpose, commercial ones included. We claim no ownership of it and no right to use it. Audio is uploaded only to produce your transcript, and only for as long as that takes. We do not use your recordings to train models.

The watermark

Videos exported without a subscription carry a small mark with our icon and the words "Made with Ghost Editor". Subscribers can turn it off.

The mark only says which app the video was edited with. It does not mean that we are affiliated with you, that we sponsor or endorse you or your content, or that we have reviewed or approved the video. You may not use it, or our name and icon, to suggest otherwise. What a video says is the responsibility of whoever made it, not ours.

The app is ours

The app, its design, its code and the Ghost Editor name belong to us. We give you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as the App Store allows. You may not copy, modify, sell or distribute the app, or build a product from it.

Subscriptions and payment

The app includes a free allowance of transcription time. Beyond it, use requires a subscription, sold through the App Store and billed by Apple to your Apple Account. Prices are shown in the app before you buy.

• Renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and are managed in your Apple Account settings, not by us.
• Introductory prices. If we offer a reduced price for a first period, it applies only to that period. The subscription then renews at the regular price, and both are shown before you buy.
• Price changes. If the price of a subscription changes, Apple tells you before the change applies to you, and you can cancel before it does.
• Withdrawal and refunds. Apple is the seller of every purchase made in the app. Your right of withdrawal, where the law gives you one, and any refund are handled by Apple under its own terms, through reportaproblem.apple.com.

What you may not do

• Use the app to process recordings of people who have not agreed to be recorded, where their agreement is required.
• Use it to produce content that is unlawful, or that infringes someone else's rights.
• Attempt to break, overload, reverse-engineer or circumvent the service or its limits.
• Resell the service or pass your access to someone else.

Other services

Signing in with Apple or Google, paying through the App Store and the providers named in our Privacy Policy are services run by other companies, under their own terms. We are not responsible for how those services work on their side.

Availability

We intend to keep the service running, but we do not promise it will be available without interruption. Transcription depends on servers that can be down, slow, or changed. Features may be added, altered or withdrawn. If we decide to stop offering Ghost Editor, we will tell you in the app in reasonable time beforehand.

Liability

The app is provided as it is. We are fully liable for damage we cause intentionally or through gross negligence, and for death or personal injury. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, for lost recordings, or for anything that follows from a transcript being wrong. Your recordings stay on your device, so keep your own copies of what matters to you. Nothing here limits your rights as a consumer, which these terms do not affect.

Ending the agreement

You may stop using the app and delete your account whenever you like. We may suspend or close an account that seriously or repeatedly breaks these terms, and will say why unless the law prevents us.

We may suspend an account at any time, without notice, if we notice fraudulent behaviour: for example creating accounts to obtain free transcription time again, abusing payments or refunds, or getting around the limits of the service. If you think we suspended your account by mistake, write to us and we will review it.

The App Store

You got Ghost Editor from Apple's App Store, so your use of the app is also governed by Apple's Licensed Application End User License Agreement and by the App Store Terms of Service. These terms add to Apple's and do not replace them. The following also applies.

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service, which also cover Family Sharing.
• Apple has no obligation to provide maintenance or support for the app. For support, write to us.
• If the app fails to conform to any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for any claim relating to the app or your use of it, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
• If someone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a United States Government embargo or designated as supporting terrorism, and that you are not on any United States Government list of prohibited or restricted parties.
• When you use the app, you must also comply with the terms of any third party that apply to that use, such as your mobile carrier's.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them Apple may enforce them against you.

Governing law

These terms are governed by the law of the Republic of San Marino, and the courts of San Marino have jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings there.

Changes

We may update these terms. If a change matters, we will update the date at the top and tell you in the app before it takes effect. Continuing to use the app after that means you accept the new version. If you do not accept it, stop using the app, delete your account and cancel your subscription in your Apple Account settings.

General

If a part of these terms turns out to be invalid, the rest still applies. If we do not enforce a right straight away, we have not given it up. These terms and the Privacy Policy are the whole agreement between you and us about Ghost Editor.
